H.R. ____, "National Institutes of Health Reform Act of 2006", was ordered favorably reported to the House, amended, by a yea-nay vote: 42 - 1.  (For further action, see H.R. 6164.)

A request by Mr. Barton to allow a report to be filed on a bill to be introduced, and that the actions of the Committee on this Committee Print be deemed as actions on that bill, was agreed to by unanimous consent.

The following amendments were offered:

An amendment offered by Mr. Barton, #1, Manager's amendment, was adopted by a voice vote;

An amendment offered by Mr. Markey, #2, re: raising authorization levels from 5% per year incease over the FY2006 baseline to 5% plus the most recent Biomedical Research and Development Price Index percentage, was defeated by a yea-nay vote: 15 - 28;

An amendment offered by Mr. Markey, #3, re: prohibiting additional amounts of money from being deposited to the "common fund" until the appropriated funding equals the FY2006 baseline plus the most recent Biomedical Research and Development Price Index percentage, was defeated by a yea-nay vote: 17 - 26;

An amendment offered by Mr. Waxman, #4, re: addition of the "Fair Access to Clinical Trials Act" to the legislation, was withdrawn;

An amendment offered by Mrs. Capps, #5, re: prohibition of termination of any national research institute, national center, or office within the Office of the Director of NIH established by statute except by enactment of a statute; prohibition of removal or transfer of any function vested in any such institute, center, or office by statute except by enactment of a statute, was defeated by a yea-nay vote: 17 - 22;

An amendment offered by Mrs. Capps and Mr. Waxman, #6, re: addition of the "Breast Cancer and Environmental Research Act of 2006" in the legislation, was defeated by a yea-nay vote: 20 - 23;

An amendment offered by Mr. Inslee, #7, re: salaries of external NIH-funded investigators, was withdrawn.

H.R. 5533, "Biodefense and Pandemic Vaccine and Drug Development Act of 2006", was ordered favorably reported, amended, to the House by a voice vote.

Mr. Barton asked unanimous consent to consider and pass five hydroelectirc licensing bills en bloc.  No objection.

H.R. 971, To extend the deadline for commencement of construction of certain hydroelectric projects in Connecticut;

S. 176, To extend the deadline for commencement of construction of a hydroelectric project in the State of Alaska;

S. 244, To extend the deadline for commencement of construction of a hydroelectric project in the State of Wyoming;

H.R. 4377, To extend the time required for construction of a hydroelectric project;

H.R. 4417, To provide for the reinstatement of a license for a certain Federal Energy Regulatory project.

Committee Resolution authorizing the issuance of subpoenas in connection with the Committee's investigation into data brokering, including its investigation into the Hewlett-Packard situation, and related matters, was approved by a yea-nay vote: 31 - 0.

Committee Resolution authorizing the issuance of subpoenas in connection with the Committee's investigation into the sexual exploitation of children over the Internet, and related matters, was approved by a yea-nay vote: 36 - 0.

H.R. ____, "Ryan White HIV/AIDS Treatment Modernization Act of 2006", was ordered favorably reported to the House, amended, by a yea-nay vote: 38 - 10.  (For further action, see H.R. 6143.)

The following amendments were offered:

An amendment offered by Mr. Towns, #1, re: adjusting the funding allocations, was defeated by a yea-nay vote: 21 - 22;

Three amendments offered en bloc by Messrs. Fossella and Engel, #2, re: (1) severity of need index; (2) decline in funding; and (3) report to Congress on progress in development of a severity of need index, was withdrawn;

An amendment offered by Mr. Pallone, #3, to strike all after the enacting clause and insert language providing for a one-year extension of the Ryan White CARE Act, was defeated by a yea-nay vote: 21 - 23;

An amendment offered by Messrs. Towns and Fossella, #4, re: inclusion of community-based organizations, clinics, hospitals and other health facilities that provide early intervention services to those persons infected with HIV/AIDS through intravenous drug use as "eligible facilities", was adopted by a voice vote.
