Committee Print (Budget Reconciliation), Title II - Medicaid, Katrina Health Care Relief, and Katrina and Rita Energy Relief, was ordered transmitted to the House Committee on the Budget, amended, by a voice vote.

Prior to the vote on transmittal, the Committee Print was adopted, amended, by a yea-nay vote: 28 - 22.

The following amendments were offered:

An amendment in the nature of a substitute to Subtitle A--Medicaid by Mr. Barton, #1, entitled "Medicaid Reconciliation Act of 2005", was adopted, amended, by a voice vote;

An amendment by Mr. Markey, #1A, to strike Subtitle A, was defeated by a yea-nay vote: 24 - 30;

An amendment by Mr. Barton, #1B, re: definition of RAMP (retail average market price), was adopted by a voice vote;

An amendment by Mr. Brown, #1C, to eliminate HMO overpayments, was defeated by a yea-nay vote: 21 - 27;

An amendment by Mr. Barton, #1D, re: limitation on use of benchmark benefit packages, was adopted by a voice vote;

An amendment by Mrs. Capps, #1E, to exempt children from the provisions of the "Medicaid Reconciliation Act of 2005", was defeated by a yea-nay vote: 21 - 26;

An amendment by Mr. Bilirakis, #1F, requiring States to permit health care providers to comply with documentation and data requirements imposed with respect to home and community-based services through the maintenance of data in electronic form rather than in paper form, was adopted by a voice vote;

An amendment by Ms. Schakowsky, #1G, to strike section 3114 - disqualifying individuals for eligibility for long-term care under Medicaid because of the value of their home, was defeated by a voice vote;

An amendment by Mr. Deal , #1H, re: coverage of rural health clinic and FQHC services under benchmark or benchmark equivalent coverage, was adopted by a voice vote;

An amendment by Mr. Pallone, #1I, to exempt active and retired members of the armed services who have served or are serving in Iraq, and their families from the provisions of the "Medicaid Reconciliation Act of 2005", was defeated by a yea-nay vote: 23 - 27;

An amendment by Mr. Deal, #1J, re: additional limitations on State option for alternative Medicaid premiums and cost-sharing (sec. 3121), was adopted by a voice vote;

An amendment  by Ms. Eshoo, #1K, re: exempting women coverage under Breast or Cervical Cancer Program from cost-sharing or benefit reductions, was withdrawn;

An amendment by Mr. Gillmor, #1L, re: children's hospital participation in section 340B drug discount program, was adopted by a voice vote;

An amendment by Mr. Strickland, #1M, to strike section 3124 -- Use of Benchmark Benefit Packages -- which would allow States to provide lesser benefits for very low-income individuals, was defeated by a yea-nay vote: 21 - 26;

An amendment by Mr. Waxman, #1N, exempting children with special needs from the provisions of the "Medicaid Reconciliation Act of 2005", was defeated by a yea-nay vote: 22 - 22;

An amendment by Ms. Eshoo and Mr. Burgess, #1O, exempting women covered under Breast or Cervical Cancer Program from cost-sharing or benefit reductions, was adopted by a voice vote;

Consideration of Subtitle A of the Committee Print was suspended; and Subtitle C - Katrina and Rita Energy Relief - was called up for consideration.

An amendment by Messrs. Rush, Green, and Markey, #2, to increase the additional spending for the Low-Income Home Energy Assistance Program from $1 billion to $3,093,000,000, was defeated by a yea-nay vote: 21 - 28;

The Committee returned to consideration of Subtitle A -- Medicaid.

An amendment by Mr. Rogers, #1P, to add a new section re: emergency services furnished by non-contract providers for Medicaid managed care enrollees, was adopted by a voice vote;

An amendment by Mr. Markey, #1Q, to strike section 3111, which would lengthen the look-back period from 3 to 5 years and change the beginning date for the period of ineligibility, was defeated by a yea-nay vote: 20 - 28;

An amendment by Mr. Buyer, #1R, to add a new section - improving patient outcomes through greater reliance on science and best practices, was adopted by a yea-nay vote: 31 - 20;

An amendment by Ms. DeGette, #1S, to assure meaningful benefits for individuals with disabilities if a doctor certifies that the services are medically necessary, was defeated by a yea-nay vote: 23 - 26;

An amendment by Mr. Rush, #1T, to assure meaningful benefits for children if a doctor certifies that the services are medically necessary, was defeated by a yea-nay vote: 24 - 28;

An amendment by Mr. Deal, #1U, re: conditions for access to home and community-based services for the elderly and disabled, was adopted by a voice vote;

An amendment by Mr. Waxman, #1V, re: exempting special needs children from the provisions of the "Medicaid Reconciliation Act of 2005", was defeated by a yea-nay vote: 24 - 29;

An amendment by Ms. Baldwin, #1W, to strike the cost-sharing changes in the Medicaid provisions, was defeated by a yea-nay vote: 22 - 27;

An amendment by Mr. Norwood, #1X, re: benchmark benefits dental coverage, was adopted by a voice vote;

An amendment by Mr. Dingell, #1Y, to increase the Medicare Physician Payment Update to 2.7% in 2006 and 2.6% in 2007; and hold beneficiary premiums harmless, was defeated by a yea-nay vote: 22 - 29;

An amendment by Mr. Pallone, #1Z, exempting certain asset transfers, made with good intentions, from disqualifying an individual for Medicaid long-term care coverage, was defeated by a yea-nay vote: 20 - 28;

An amendment by Mr. Wynn, #1AA, re: nondiscrimination against individuals with cognitive impairment, was defeated by a voice vote;

Two amendments offered en bloc by Mr. Davis, #1BB, exempting special needs children from prescription drug copayment change, was defeated by a yea-nay vote: 22 - 24;

An amendment by Mr. Waxman, #1CC, re: limitation on the enforcement of increased cost sharing, was defeated by a yea-nay vote: 22 -27;

An amendment by Ms. Solis, #1DD, to strike section 3145 relating to enforcement of documentation requirements, was defeated by a yea-nay vote: 19 - 27;

An amendment by Mr. Stupak, #1EE, to eliminate the new tax on States which requires States to contribute to the Medicare drug costs of dual eligibles (referred to as clawback payments), was defeated by a yea-nay vote: 20 - 27;

An amendment by Mr. Ross, #1FF, re: Federal Upper Limit (FUL) and best price, was defeated by a yea-nay vote: 19 - 27;

An amendment by Mr. Gonzalez, #1GG, exempting diabetics from the provisions of the "Medicaid Reconciliation Act of 2005", was defeated by a voice vote;

An amendment by Mr. Gonzalez, #1HH, to create the Office of the National Coordinator for Health Information Technology, was ruled not germane;

An amendment by Mr. Inslee, #1II, to provide authority for qualifying States to use portion of SCHIP allotment for any fiscal year for certain Medicaid expenditures, was withdrawn;

An amendment by Mr. Stupak, #1JJ, to strike section 3142, which limits managed care organization provider tax, was defeated by a yea-nay vote: 19 -27;

An amendment by Ms. Solis, #1KK, to exempt foster care children and children provided adoption assistance from the provisions of the "Medicaid Reconciliation Act of 2005", was defeated by a voice vote;

An amendment by Mrs. Capps, #1LL, re: extension of Transitional Medical Assistance, was withdrawn;

An amendment by Mr. Engel, #1MM, re: optional Medicaid coverage for low-income individuals with HIV, was defeated by a yea-nay vote: 21 - 25;

An amendment by Mr. Deal, #1NN, re: transportation brokerage, was adopted by a voice vote;

An amendment by Mr. Strickland, #1OO, permitting re-basing of clawback provision by States, was defeated by a yea-nay vote: 20 - 26;

An amendment by Mr. Deal, #1PP, re: annuities, was adopted by a voice vote;

An amendment by Mr. Dingell, #1QQ, re: adjustment in computation of Medicaid FMAP to disregard an extraordinary employer pension contribution, was adopted by a voice vote;

The Committee concluded consideration of Subtitle A and took up amendments to Subtitle B -- Katrina Health Care Relief.

An amendment by Mr. Green, #3, replacing the subtitle, was withdrawn (prior to withdrawal, Mr. Green asked unanimous consent to strike sec. 3205 and sec. 3206 of his amendment-- no objection heard);

An amendment by Mr. Burgess, #4, re: recomputation of HPSA, MUA, and MUP designations within Hurrican Katrina affected areas, was adopted by a voice vote;

An amendment by Mr. Burgess, #5, re: FMAP hold harmless for Katrina impact, was adopted by a voice vote;

An amendment by Mr. Pickering, #6, re: targeted Medicaid relief for States affected by Hurricane Katrina, was adopted by a voice vote.
