H.R. 3717, Broadcast Decency Enforcement Act of 2004, was FORWARDED to the full committee by a voice vote.

The following amendments were offered:

An amendment by Mr. Markey, #1, re: basing penalties on revenues, was withdrawn by unanimous consent;

An amendment by Mr. Stearns, #2, re: sense of the Congress on reinstitution of the National Association of Broadcasters family viewing policy, was withdrawn by unanimous consent;

Two amendments offered en bloc by Mr. Rush, #3, re: recording of programming, deadline for regulations, and extension of definition of indecency to include broadcasting of gratuitous violence, was withdrawn by unanimous consent;

An amendment by Mrs. Wilson, #4, re: license renewal consideration of violations of indecency prohibitions, was withdrawn by unanimous consent;

An amendment by Mr. Green, #5, re: indemnification of affiliated broadcast station licensees from 90% of penalties if language found to be obscene was within programming provided by the network organization, was withdrawn by unanimous consent;

An amendment by Mr. Walden, #6, re: additional factors to consider in indecency penalties, was withdrawn by unanimous consent; and

An amendment by Mr. Wynn, #7, re: revocation of license proceedings for multiple violations (3 or more) of indecency prohibitions, was withdrawn by unanimous consent.
