The Committee on Energy and Commerce met in open markup session and took the following actions:

H.R. 5613, the “Protecting the Medicaid Safety Net Act of 2008”, as amended by the Subcommittee on Health, was ordered favorably reported, amended, by a yea-nay vote: 46-0.

The following amendments were offered:

A manager's amendment offered by Mr. Dingell, # 1, was adopted by a voice vote.

An amendment offered by Mr. Deal, # 2, was withdrawn by unanimous consent.

An amendment offered by Mr. Deal, # 3, was defeated by a roll call vote: 15 – 26.

An amendment offered by Mr. Burgess, # 4, was withdrawn by unanimous consent.

An amendment offered by Mr. Fossella, # 5, was withdrawn by unanimous consent.
