Bipartisan E&C Leaders Request Briefing from NBA Commissioner Adam Silver Following Allegations of Sports Fixing and Illegal Gambling

WASHINGTON, D.C. – Today, House Committee on Energy and Commerce Chairman Brett Guthrie (KY-02) and Ranking Member Frank Pallone Jr., (NJ-06), along with Energy and Commerce Subcommittee on Oversight and Investigations Chairman John Joyce, M.D. (PA-13) and Ranking Member Yvette D. Clarke (NY-09), and Energy and Commerce Subcommittee on Commerce, Manufacturing, and Trade Chairman Gus Bilirakis (FL-12) and Ranking Member Jan Schakowsky (IL-09), sent a letter to National Basketball Association (NBA) Commissioner Adam Silver following the recent announcement that current and former NBA players and coaches have been indicted on charges relating to sports fixing and illegal gambling. KEY EXCERPT: These allegations raise serious concerns about sports betting and the integrity of sport in the NBA, which harms fans and legal sports bettors. [...] To assist the Committee in its oversight, we request a briefing by no later than October 31, 2025, that addresses the following: Details about the fraudulent, illegal, and alleged betting practices in connection with NBA players, coaches, and officials, including the actions of NBA players and coaches identified in the recent indictment; as well as prior instances, some of which are identified above. Actions the NBA intends to take to limit the disclosure of nonpublic information for illegal purposes. Whether the NBA’s Code of Conduct for players and coaches effectively prohibits illegal activity, including the disclosure of non-public information for the purposes of illegal betting schemes. An explanation of the gaps, if any, in existing regulations that allow illegal betting schemes to occur. Whether and how the NBA is reevaluating the terms of its partnerships with sports betting companies. BACKGROUND: According to the unsealed indictment, current and former NBA players and coaches allegedly used insider information to place or profit from bets on NBA games. The federal indictment’s allegations of illegal betting span incidents of fraudulent wagering from December 2022 to March 2024 and involve defendants and co-conspirators residing across the United States. In 2023, it is alleged that Miami Heat player Terry Rozier left a game early to facilitate a co-conspirator’s winning bet, which produced hundreds of thousands of dollars in winnings to be split with Mr. Rozier. Another co-conspirator, former NBA player Damon Jones, is alleged to have gained access to non-public information on NBA players and teams, which he then sold to professional gamblers. Other unnamed co-conspirators are alleged to have passed along insider information as well, such as which players would not be playing in an upcoming game. In 2007, former NBA referee Tim Donaghy pleaded guilty to federal charges for using insider information to bet on games he officiated. Last year, Toronto Raptors player Jontay Porter was banned from the NBA for life after pleading guilty to wire fraud conspiracy due to his involvement in a sports betting scandal. WTAS: E&C Republicans’ Agenda “Continuing the Fight Against Fraud”

WASHINGTON, D.C. – Today, Congressman Brett Guthrie (KY-02), Chairman of the House Committee on Energy and Commerce, highlighted additional statements of support for Energy and Commerce Republicans’ agenda “Continuing the Fight Against Fraud.”

Don’t miss what advocates are saying:

Minnesota State Representative Kristin Robbins, House District 37A, in support of Medicaid Whistleblower Protection Act:

“I am so grateful for the leadership of Congresswoman Miller-Meeks and the House Energy & Commerce Committee for introducing this Whistleblower Protection bill. Too often, as we have seen in Minnesota, brave whistleblowers are retaliated against by politicians and agency leaders who are more interested in protecting their political base than taxpayers and vulnerable citizens. The federal, state and county workers who run these programs are often the first to see red flags but, as we have seen time and again in Minnesota, if they dare to point it out, they are called racist, accused of creating a hostile work environment, demoted, reassigned or otherwise harmed personally and professionally.

“The Whistleblower Protection bill will expand protections for federal, state and county employees so they can do what they do best – serve the public, help vulnerable citizens and protect taxpayers’ hard-earned money. States across the country should look at their own whistleblower protection statutes and ensure that whistleblowers can report to someone outside their agency, such as legislators, federal officials, or law enforcement. They should also make sure the statute of limitations is long enough to provide robust protection for whistleblowers and to ensure fraud crimes are prosecuted. These cases can take years to come to light and investigate, and we need to ensure accountability by providing at least a 10-year statute of limitations.

“I am so grateful for the brave whistleblowers who CONTINUE to reach out and expose fraud in Minnesota, often at great personal and professional risk. They have made an enormous difference in our state, and it has led to the national efforts to fight fraud across the country. The whistleblowers are unsung heroes, and they deserve our protection at the state and federal level.”

Rachel Barkley, Director, Able Americans:

“Medicaid is a lifeline for millions of Americans with disabilities, making it possible for people to receive essential health care and long-term services and supports, live independently, and participate in their communities. Protecting the integrity of this program is essential to protecting the people who depend on it.

“Able Americans applauds the House Energy and Commerce Committee for advancing commonsense reforms to combat fraud, waste, and abuse in Medicaid and strengthen accountability for taxpayer dollars. Every dollar lost to fraud is a dollar that cannot be used to provide services and supports to people who genuinely need them.

“We particularly welcome efforts to strengthen oversight of home- and community-based services while preserving states’ ability to administer programs effectively. Strong program integrity and strong services for people with disabilities are not competing goals—they go hand in hand.

“Americans with disabilities deserve a Medicaid program that is sustainable, accountable, and focused on the people it was created to serve.”

Brandon Arnold, Executive Vice President, National Taxpayers Union:

“National Taxpayers Union (NTU) applauds Chairman Brett Guthrie and his colleagues on the House Energy and Commerce Committee for introducing a series of bills to root out fraud and abuse in the Medicaid program. With the national debt now exceeding $40 trillion, it’s imperative to cut the fat out of the federal budget. That process should begin with reducing waste, fraud and abuse in programs like Medicaid, which issued more than $31 billion in improper payments in fiscal year 2024. NTU looks forward to working with the Chairman and members of the Committee on this critically important effort.”

Dean Clancy, Senior Health Policy Fellow, Americans for Prosperity:

“Congratulations to members of the House Energy and Commerce Committee for leading the fight to eliminate wasteful spending in Medicaid, an essential part of making health care affordable for all Americans. Too many safety-net dollars today are diverted from needy families to greedy fraudsters, or else lost to bureaucratic errors and weak financial controls. This ultimately inflates costs for everyone. By giving states strong new tools to detect, prevent, and recoup funds, you are protecting not only the taxpayer but also patients’ access to affordable health care.”

Jenn Pellegrino, Founder, Defend Forgotten America:

“Defend Forgotten America applauds the House Energy and Commerce Committee’s efforts to strengthen Medicaid program integrity by giving states better tools and incentives to detect fraud, recover improper payments, improve accountability, and ensure taxpayer dollars reach the patients and providers who legitimately depend on them.

“Importantly, these bills would increase transparency, coordination, and data sharing among local, state, and federal agencies so officials can identify vulnerabilities and fraudulent activity earlier and act on reliable, actionable information.

“Energy and Commerce Republicans are putting forth commonsense reforms that can improve accountability across every level of government and protect the long-term integrity of Medicaid for the Americans it was designed to serve.”

Maya MacGuineas, President, Committee for a Responsible Federal Budget and Fix the Debt:

“We should be focusing on the best ways to bring health care costs down for the federal government; that includes making every effort to ensure health care spending actually pays for care. Focusing on opportunities to strengthen program integrity, improving managed care oversight, and going after improper payments ultimately makes Medicaid – and our fiscal health overall – healthier in the long-run. Lawmakers are right to expand the Medicaid Recovery Audit (RAC) program which takes a commonsense step toward this goal, and we applaud it.”

Bipartisan E&C Leaders Probe Amateur Athletic Union Regarding Sexual Abuse Allegations

WASHINGTON, D.C. – Today, House Committee on Energy and Commerce Chairman Brett Guthrie (KY-02) and Ranking Member Frank Pallone Jr., (NJ-06), along with Subcommittee on Oversight and Investigations Chairman John Joyce, M.D. (PA-13) and Ranking Member Yvette D. Clarke (NY-09), and Subcommittee on Commerce, Manufacturing, and Trade Chairman Gus Bilirakis (FL-12) and Ranking Member Jan Schakowsky (IL-09), sent a letter to the Amateur Athletic Union (AAU) regarding recent allegations of sexual abuse within the organization.

The letter requests documents and information about the number of allegations and reports of abuse, procedures for investigating complaints of abuse, enforcement of suspensions and bans against coaches, and the organization’s administration of child safety and abuse training. The letter also requested that the AAU provide the Committee with a briefing on this matter.

KEY EXCERPTS:

“ProPublica’s reporting describes numerous abuse cases involving AAU coaches that occurred even after the organization’s updated child protection policies were reportedly put in place in 2012.”

[...]

“It is unacceptable that AAU is failing to implement standard reforms to protect child athletes and is misleading the public, parents, and athletes about preventative measures in place within AAU sports.”

BACKGROUND:

The AAU has almost 800,000 athletes participating in more than 50 sports programs across the United States. ProPublica and the Washington Post’s investigation highlighted multiple instances of the AAU failing to properly prevent and address athlete abuse.

The ProPublica and Washington Post report found that the AAU:

Falsely claimed to offer child abuse prevention training;
Does not mandate coaches take the training they do provide;
“Has become a haven for coaches suspected of abuse”; and
Did not abide by its 2012 pledge to enforce the use of lists of banned and suspended coaches accused or found guilty of misconduct in other organizations.

Past Energy and Commerce Committee investigations into sexual abuse in the Olympic and Paralympic movement led to significant reforms, including the creation of a publicly searchable database of suspended or banned individuals.

WTAS: E&C Republicans’ Agenda “Continuing the Fight Against Fraud”

WASHINGTON, D.C. – Today, Congressman Brett Guthrie (KY-02), Chairman of the House Committee on Energy and Commerce, highlighted widespread support for Energy and Commerce Republicans’ agenda “Continuing the Fight Against Fraud."

Don’t miss what advocates are saying:

Scott Partika, Director, Ohio Department of Medicaid, in support of the Strengthening Medicaid Analytics to Reduce Theft (SMART) Act:

“We welcome initiatives that strengthen state–federal collaboration to safeguard the Medicaid program and appreciate Congressman Balderson’s leadership on the SMART Act. Expanding access to interoperable analytic tools would meaningfully support Ohio Medicaid’s oversight and transparency efforts and help further prevent fraud, waste, and abuse.”

Lanhee J. Chen, Ph.D., David and Diane Steffy Fellow in American Public Policy Studies and Co-Chair, Health Care Policy Working Group, Hoover Institution at Stanford University:

“This comprehensive package of legislation includes important reforms that will ensure that Medicaid continues to serve those who are legitimately eligible for the program, while cracking down on fraudsters seeking to cheat American taxpayers. By enhancing program integrity, making data-analytic tools widely available to assist in the detection of program waste, fraud and abuse, and aligning incentives to ensure that states share in the responsibility of ensuring Medicaid benefits only go to those who should get them, these bills will ensure that Medicaid operates not only more effectively, but in a more fiscally sustainable manner. Congratulations to Chairman Guthrie on his leadership and to the members of the Committee who have sponsored these important pieces of legislation.”

Keith Miskie, President of United Council on Welfare Fraud (UCOWF), in support of the Medicaid Whistleblower Protection Act:

“Imagine two individuals doing the same day-to-day work in the same federal safety net program, but one does it as a federal employee in Washington, DC while the other does it as a state or local employee. The one in Washington, DC as a federal employee enjoys full federal whistleblower protections versus the state or local employee that identifies wrongdoing does NOT, putting themselves and their families at personal risk. Sadly, this is the reality in our nation. This ‘second class citizen’ approach to state and local fraud fighters represents a serious gap in our nation’s efforts to curb fraud, waste, and abuse. America’s fraud investigators are the frontline defenders of beneficiaries and taxpayers, and as the ‘boots on the ground’ ensuring our nation’s safety net is preserved for future generations, they desperately need this legislation. So, on behalf of the United Council on Welfare Fraud – the nation’s only professional organization solely dedicated to the prevention, detection, investigation, prosecution, and recovery of fraud in public assistance programs – we applaud the introduction of this legislation, and look forward to working with Chairman Guthrie, and his colleagues in the House, Senate and Administration to make this a reality and create an even playing field for America’s fraud fighters.”

Tarren Bragdon, President and CEO at the Foundation for Government Accountability:

“Medicaid exists to serve the truly needy, but bureaucrat-created loopholes and weak guardrails have left the program wide open to fraud, waste, and abuse. Every dollar taken by fraud is a dollar robbed from taxpayers and from the very people most relying on Medicaid. This builds on the anti-fraud reforms Congress passed in the One, Big, Beautiful Bill, giving states and federal officials the tools to stop fraud, claw back improper payments, and hold bad actors accountable. FGA applauds the Energy and Commerce Committee for leading the charge.”

Kevin Garcia-Gallindo, Policy Associate, The LIBRE Initiative:

“Latinos have a vested interest in ensuring Medicaid remains strong for those who truly need it. As the youngest major racial or ethnic demographic in the country, young Latinos are more likely to help finance the program today than rely on it, giving them a significant stake in its long-term sustainability. Yet Medicaid’s greatest vulnerability is that too many safety-net dollars never reach the families the program was designed to serve. Instead, billions are lost to fraud, administrative errors, and weak oversight. When taxpayer dollars are wasted, the people who suffer most are the patients who depend on Medicaid for care. Every state should use the strongest tools available to detect, prevent, and recover improper payments. Doing so not only protects taxpayers, but also helps ensure that more resources are directed to vulnerable families and preserves access to affordable, high-quality health care for those who need it most.”

Bill Rouse, President, The Transportation Alliance, in support of the Strengthening Tools for Oversight to Prevent (STOP) Medicaid Fraud Act:

“Congressman Evans’ legislation is an important step toward bringing greater accountability to NEMT. Requiring electronic verification that a Medicaid-funded trip actually occurred will help identify fraud, stop payments for services never provided, and protect responsible operators from having to compete against bad actors gaming the system. That means more resources for the patients who depend on NEMT and greater accountability for the taxpayers who fund it. We thank Congressman Evans and the House Energy and Commerce Committee for advancing a common-sense reform that strengthens NEMT for patients, providers, and taxpayers alike.”
