In the News: E&C Members Lead on Protecting Americans’ Data and National Security

After a unanimous vote in the Energy and Commerce Committee, H.R. 7521, the Protecting Americans from Foreign Adversary Controlled Applications Act , passed the House of Representatives with a vote of 352 – 65. Following the strong, bipartisan vote, Energy and Commerce Republicans touted the bill’s widespread support. Highlights and excerpt from the interviews: Rep. Latta on NewsNation: “This is something that the House has been working on for over a year. When Mr. Chew [CEO of TikTok] appeared before us in Committee, I asked him if anyone in Communist China could see this data from Americans users of the app. ‘Yes it could be,’ was his response. We’ve also had security briefings. That’s one of the other big concerns here is the national security of the United States and making sure we protect our citizens from the Communist Chinese accessing their information.” […] “TikTok is owned by ByteDance, and under Communist Chinese law, anything that the government wants, if you’re a Chinese company, you have to give it to the government. What we’re saying in the legislation is if ByteDance, which is the parent [company], divests themselves of TikTok, TikTok can still be used here in the United States.” Rep. Walberg on Scripps News: “We’re not attempting to ban TikTok. […] That’s what TikTok wants its users and subscribers to think we’re doing, but it's not true. We have said that TikTok can remain as long as it's not connected to an adversarial country—China, Russia, North Korea, Iran.” […] “For the purposes of national security, we don’t want something like TikTok, with 170 million users, to have access opportunity from the CCP. That’s a dangerous setting. So, we have said we’re not banning. It can continue on, but it cannot be owned by any company that is controlled by the CCP and that’s ByteDance. It is wholly responsible to the CCP and that’s a dangerous thing. Rep. Cammack on America’s Newsroom: “The thing that’s really concerning is that the CCP has come out and said they would rather see us ‘ban’ TikTok than divest. [ByteDance] stands to make billions of dollars through divestment, but instead the Chinese government is more concerned with having unfettered access [to U.S. data].” […] “Just this time last year, the CEO of TikTok told my Committee that they didn’t have access to geolocation data. But, it turns out, they tapped into the geolocation data of their users, and if you were in an Energy and Commerce Committee Member’s district, you couldn’t use the app until you actually called through the app. They say that they don’t [surveil Americans], but we know that they do.” Rep. Pfluger on Yahoo Finance: “The goal here is we want to make sure Americans are safe. We want to make sure that data is safe. We want to make sure that a foreign adversary is not taking advantage of an application and using Americans and our privacy to their advantage.” […] “This is not about content. It’s about conduct. In fact, we hope that the application can actually continue, but it needs to happen with a trusted purchase, and so far the Chinese Communist Party has a direct tie to ByteDance. It’s about the link to a foreign adversary that has control over it. […] It’s about divesting and putting that company and the application in the hands of trusted agents which are either American businesses or friendly countries.” Rep. Carter on The Claman Countdown: “The House of Representatives has spoken. They have said we’re not going to shun our responsibility of protecting our homeland and our citizens. Instead, we’re not going to let a Chinese Communist Party-owned app operate here in America. Now, if they want to divest themselves and sell their company, […] that’s fine.” […] “This is a decision TikTok’s got to make. If they will divest themselves, then TikTok continues on and people will continue to enjoy it and continue to watch it.” […] “[The vote] was overwhelming in the House— 352 votes. I think that sends a strong message to the Senate. […] The Senate needs to take up this bill and they need to pass this bill. The White House has already said that they would sign it.” Rep. Crenshaw on the Brian Kilmeade Show: "If you're a company in China, you have to do whatever [the CCP] tells you, and you have to spy on whoever [the CCP] tells you to spy on." [...] "[They] can weaponize that kind of tool, and the Chinese have already been shown to have weaponized it. I don't want a situation where we're in an adversarial relationship with the Chinese Communist Party, and they have the ability to manipulate the minds and opinions of tens of millions of Americans."

E&C Republicans Demand Answers from TikTok over Terrorist and Antisemitic Content

Washington D.C. — House Energy and Commerce Committee Chair Cathy McMorris Rodgers (R-WA), Communications and Technology Subcommittee Vice Chair Buddy Carter (R-GA), and 23 other Republican Committee members sent a letter to TikTok demanding answers regarding how the Chinese Communist Party is using the app as a tool to surveil and manipulate Americans.  From the letter: “ Disturbingly, millions of TikTok users have recently viewed videos glorifying Osama Bin Laden’s ‘Letter to America,’ which attempts to justify his horrific murder of 3,000 Americans in the September 11, 2001, attacks while also perpetuating ‘the antisemitic trope claiming the Jews ‘control your policies, media and economy.’” Key excerpts from exclusive reporting by FOX NEWS : “ A group of House Republicans is demanding more transparency from TikTok about how content is amplified and how much insight China has into those processes as accusations mount against the social platform that it’s boosting antisemitic videos. “‘On October 7, the Palestinian terrorist organization, Hamas, brutally attacked Israel and killed more than 1,400 people. Since this terrorist attack, disinformation related to the conflict has run rampant on your platform, stoking antisemitism, support, and sympathy for Hamas,’ they wrote to TikTok CEO Shou Zi Chew. “The letter is being led by Rep. Buddy Carter, R-Ga. It comes just days after TikTok was under fire for facilitating a surge in viral videos expressing support for Usama bin Laden’s 2002 'Letter to America' written in the wake of the Sept. 11, 2001, terror attacks.” […] “National security hawks have been wary of TikTok’s connection to China, with its parent company ByteDance being based in Beijing.” […] “The lawmakers are demanding to know how many employees at TikTok have connections to ByteDance, how the platform screens for misinformation and anti-Israel content amid the conflict with Hamas, and how its algorithms are curated, among other queries. “‘Given that roughly half of TikTok’s U.S. user base is under 25 years old, American youth are being exposed to extremely violent and disturbing images and videos," they wrote. "This deluge of pro-Hamas content is driving hateful antisemitic rhetoric and violent protests on campuses across the country. ICYMI: E&C Republicans Turn Up the Heat and Demand Biden Stop Efforts to Ban Gas Stoves

President Biden wants to control every aspect of our lives—from what kind of cars we can drive, how we can heat our homes, and now how we’re allowed to cook food for our families. Last week, it was reported that the Biden administration is looking to ban gas stoves from American homes across the country. This is just the latest in a long line of power grabs by the radical Left. It's not about public safety, but rather about telling the American people the federal government knows what’s best. Nearly 35% of homes in the U.S. – more than 40 million Americans – use a natural gas stove. That’s why Energy and Commerce Committee Chair Cathy McMorris Rodgers (R-WA) and 86 of her House Republican colleagues sent a letter to President Biden demanding the administration reverse any attempts to ban gas stoves. Chair Rodgers also sent a letter to the Consumer Product Safety Commission (CPSC) echoing these concerns.  Highlights and excerpts from the Fox Business exclusive coverage on the letter to President Biden : Furious lawmakers are calling on President Biden to cease any efforts by his administration to ban natural gas stoves inside Americans' homes. "Banning natural gas stoves is not about public safety – it is another example of government control; like other policies we have seen from your administration, to tell Americans what kinds of cars they can drive, how they heat their homes, and how to live their lives." The Biden administration caused an uproar over gas stoves earlier this week after a commissioner on the U.S. Consumer Product Safety Commission (CPSC) suggested regulators were considering banning the appliance due to health and safety concerns. Biden Drained SPR by 40 Percent in Less Than Two Years

He’s Depleted the SPR More Than Every President Combined Since day one in office, President Biden has waged war on American fossil energy. This has led to 40-year high inflation and made everyday life more expensive for people across the board—from the gas pump to the grocery store. To cover up his failed “rush-to-green” agenda, President Biden is depleting our Strategic Petroleum Reserve (SPR). He has sold off more than 200 million barrels—nearly 40 percent of the stockpile—while in office. This is more than all the U.S. presidents in history combined. As a result, the SPR is now at its lowest level since 1984 – and the administration has no plan to refill it. This morning, his administration announced an additional 15 million barrels would be drained from the SPR to bailout Democrats ahead of the midterms, further surrendering both our energy security and national security to countries like Russia, China, Saudi Arabia, and Venezuela. BOTTOM LINE:  President Biden is depleting our strategic reserves at a record rate. We’re going to run dangerously low—and be unprepared for a true emergency—if his reckless actions continue. If President Biden was serious about lowering prices across the board—and not just interested in an election year gimmick—he would work with Republicans on solutions to flip the switch for more American energy production. House Republicans on Energy and Commerce have sounded the alarm for months on the administration’s misuse of the Strategic Petroleum Reserves (SPR), including introducing legislation to reverse course on Biden’s energy crisis. House Democrats have blocked EVERY SINGLE BILL.  Here’s the proof: In  November 2021 , after President Biden released 50 million barrels of crude from the Strategic Petroleum Reserves, E&C Republicans  urged  Biden to work with American energy producers to boost production here – not beg OPEC to pump more oil or coordinate with China on releasing strategic reserves.  In  December 2021 , E&C Republican Leader Cathy McMorris Rodgers introduced a bill to require the Secretary of Energy to develop a plan to increase oil and gas production on Federal lands if the president uses our country’s SPR for non-emergency reasons.  Democrats  blocked it  – doubling down on high gas prices and President Biden’s energy crisis. In  February 2022,  Republican Leaders Cathy McMorris Rodgers and Bruce Westerman  introduced  the American Independence from Russia Act which flips the switch to unleash American energy production. It immediately approves the Keystone XL pipeline, removes all restrictions on U.S. LNG exports, restarts oil and gas leasing on our federal lands and offshore waters, and requires DOE to make a plan to replace drawn down oil from the SPR. To date, House Democrats have  BLOCKED  the American Energy Independence from Russia Act  SIX TIMES. In  June 2022 , E&C Republican Leaders Leader Cathy McMorris Rodgers and Fred Upton sent a letter to Secretary Granholm  demanding answers  for the how the administration “is rapidly depleting the nation’s petroleum reserves ahead of elections in November, while failing to establish long-term plans” to replenish the reserves. We received  no reply  from Secretary Granholm. In July 2022, House Republicans   demanded answers from the administration as to why our emergency energy reserves were being sent to foreign adversaries like the Chinese Communist Party, compromising our energy security and national security. Also in  July 2022 , Democrats  blocked  E&C Republican Leader Cathy McMorris Rodgers’ amendment,  introduced by Rep. Jeff Duncan , to stop the Biden administration from selling our strategic energy reserves to China. Democrats would rather send our reserves to communist dictatorships than keep America powered during emergencies. In  September 2022 , E&C Republicans led a resolution of inquiry to hold the Biden administration for draining our SPR, jeopardizing our national security and energy security. E&C Democrats  BLOCKED  our efforts to hold the Biden administration accountable. Today , E&C Republican Leader Cathy McMorris Rodgers  called out  the Biden administration’s plans to further drain our strategic reserves. Rep. Jeff Duncan (R-SC)  wrote an op-ed on how Democrats’ rush-to-green scheme isn’t asenvironmentally friendly as they claim. Highlights and key excerpts: Without question, there is a lot of gaslighting when it comes to discussions surrounding clean energy.  The “Green New Left” wants to pick winners and losers in the energy sector and promote their narrow scope of “clean” energy,  but their solutions are not always effective or as environmentally friendly as they make them out to be. I support the use of “clean” energy, but in the context of a market-driven, all-of-the-above strategy that also includes nuclear, natural gas, hydropower, and clean coal. […] However, I have serious concerns regarding the Democrats’ attempts to narrow the scope of our energy sector to include only what they consider to be “clean” energy. […] Take electric vehicles, for example, the Biden Administration’s apparent “solution” to climate change. Relying solely on lithium-ion batteries, an industry dominated by China and often fueled by exploitive child labor, a “clean” electric vehicle comes with a lot of baggage. In reality, electric vehicles have a remarkably dirty life cycle and generate more emissions during their manufacturing than gas-powered vehicles, mostly due to the production of batteries. The rare earth minerals necessary for the essential magnets in EVs are often mined in countries with little to no environmental regulations or regard for human rights. For example, lithium and cobalt are essential for EV batteries and for storing power from wind and solar, and over 60% of the world’s cobalt supply comes from the Democratic Republic of Congo where young children work in the mines. […] Instead of forcing a narrow “clean” energy strategy and making the choices for consumers as the Democrats try to do,  Republicans support an all-of-the-above energy solution that allows science, technology, innovation, and the market to lead the way. Nuclear energy, for instance, is clean, reliable, affordable, and secure, and is the only carbon-free energy source that is available 24/7/365.  South Carolina’s nuclear power reactors produce 95% of the state’s carbon-free electricity and over half of the state’s total electricity, generating enough electricity each year to power over four million households across the state. The Biden administration is using the energy crisis and high gas prices to push wind, solar, and electric vehicles on Americans in the name of “clean energy” while killing domestic energy production.  As I’ve said before look to Europe’s impending winter of blackouts to see where a radical rush to a “clean” energy agenda would take us.  We should instead focus on unleashing the United States’ abundant, reliable, and affordable energy resources instead of pigeonholing ourselves in the Democrats’ “clean” energy agenda. Highlights and key excerpts: America’s nuclear energy sector has been on the back burner for too long. After decades of neglect, the first new commercial reactor in 30 years will come online early next year with the completion of Plant Vogtle’s Unit 3 in Georgia. While this is welcome progress,  America’s nuclear energy capabilities are deteriorating right when we need reliable baseload power to meet our ever-growing electricity demand. This isn’t just an energy concern, it’s a national security concern.  From mining to power generation, our world class nuclear industry is losing its competitive advantage to our adversaries primarily Russia and China. […] By investing in nuclear here, and encouraging our allies to do the same,  we can eliminate energy dependence on these nations, encourage development, and promote national security for democratic nations worldwide. […] That is why, alongside my Democrat colleague Rep. Scott Peters, I have introduced the Global Nuclear Energy Assessment and Cooperation Act. This bill will take a multi-pronged approach to promoting nuclear energy around the globe. First, it will prohibit the import of fuels from hostile foreign nations, including Russia and China. This will encourage energy independence and prevent our country from becoming reliant on our enemies for our nuclear energy needs. Second, it will introduce a program the “International Nuclear Reactor Export and Innovation Branch” at the Nuclear Regulatory Commission to focus our international nuclear efforts, including training and sharing expertise with our allies. This will inspire coordination, research, and development for the U.S. and our allies, so we can create a safe and secure world. Climate change is real and we must protect our environment. Doing so will  require an all-of-the-above energy strategy that acknowledges the role of the baseload, emission-free energy that only nuclear can provide, along with other intermittent renewable energy sources in our country’s power grid. […] There is much more that needs to be done for nuclear to flourish in the U.S.  We must make it easier to pursue nuclear projects, including permitting reform and cutting unnecessary regulations without sacrificing the U.S. private nuclear industry’s pristine standard of safety and reliability. This is how we begin to secure a safe, reliable energy future for the United States of America and democracies across the globe. Michael Burgess (R-TX)  urged the Biden administration to flip the switch on American energy production to regain our energy independence. A cold and possibly long winter lays ahead of us. While I have not consulted my farmer’s almanac, I can forecast that any federal energy policies that rush to “green” by picking winners and losers in the energy marketplace will be in for a long and cold winter one highlighted by blackouts and gas shortages.  The administration’s top-down approach toward energy policy will have serious and harmful effects on our nation.  Energy technologies that have demonstrated that they are resilient and capable of operating in inclement weather should be a top priority for policy makers. […] In a misguided rush to drastically lower carbon emissions, the European Union (EU) outsourced all their energy production to Russia and surrendered their sovereignty in the process.  Nations within the EU reasoned that the advent of the green economy was imminent. Soon every home would be powered by wind and solar.  Unfortunately, despite generous subsidies, mandates, and the criminalization of oil and gas exploration on the continent, renewable energy sources, such as wind and solar, have yet to demonstrate that they are able to be reliable contributors.  Any energy production system that is reliant on sunny days and gales of wind is not logical. I doubt there is anyone who does not expect their fridge to work on cloudy days or windless mornings. If we truly want to reach carbon neutrality and assist our EU allies from being held hostage by Russia, American energy technology and products must become a global solution. […] American resources have not evaporated overnight. The Permian Basin has not run dry, the Keystone Pipeline XL could be back on the path to completion by the stroke of the President’s pen, and America could slash carbon emissions by Congress upholding its promise with Yucca Mountain. The solutions proposed by the Democratic controlled Congress are not workable. Their “solutions” will result in the United States becoming reliant on Russian gas, Saudi Arabian oil, and Chinese solar panels and batteries. […] Most recently hidden within the American Inflation Reduction Act was $370 billion worth of Green New Deal policies, threatening our national and energy security.  It is unclear why this administration decided energy dependence is better than energy independence.  Democrats further attack American energy producers by taxing natural gas production. This tax will affect nearly every corner of our economy  as natural gas is used in heating, manufacturing, and electricity generation. A natural gas tax will have you paying more to warm your home, cook your food, and at the checkout counter. […] The Democrats’ reckless spending, poor planning, and short sightedness will set our country up for failure reducing our energy security, our global leadership, and our environmental impacts. America must not allow itself to become dependent to our adversaries to supply our energy needs.  It is only through American energy leadership and independence that we can ensure our national security, more jobs at home, and a cleaner environment. House Republicans to Biden: Put American Energy Workers First, Don’t Reward Foreign Oil Producers

93 Republicans Warn Biden that OPEC+, Including Russia, Wins if He Bans American Oil Exports Washington, D.C. — House Republicans are demanding President Bidenabandon his anti-American energy agenda, including any plans to cut off America’s access to global energy markets by imposing a ban on oil exports. In a new letter, Energy and Commerce Committee Republican Leader Cathy McMorris Rodgers (R-WA), House Republican Leader Kevin McCarthy (R-CA), and 91 Republican representatives tell President Biden that banning America’s crude oil and petroleum product exports will make the self-inflicted energy crisis even worse, by hurting American energy workers, increasing gas prices, and further emboldening America’s adversaries, especially Russia.  Recent studies show the benefits of the U.S. exporting crude oil, as well as the harmful impacts of banning the exporting of U.S. petroleum products.  The following are excerpts from House Republicans letter to President Biden:  AN EXPORT BAN HURTS OUR ECONOMY AND SECURITY: “Banning oil exports would destroy American jobs and lead to higher energy prices for the hardworking people of this country already suffering under record high inflation. Furthermore, banning American oil exports would punish our allies in Europe and Asia who desperately seek to reduce their reliance on OPEC and Russia for oil. The only beneficiary of a ban on American oil exports would be Russia, which would gain geopolitical leverage over our allies and additional revenue to finance the unjustified war on Ukraine.” WHY LIFTING THE EXPORT BAN PUT AMERICA FIRST: “In 2015, when Congress passed bipartisan legislation to repeal 1970’s-era restrictions on crude oil exports, it found that ‘the United States upholds a commitment to free trade and open markets and has consistently opposed attempts by other nations to restrict the free flow of energy; and, the United States should remove all restrictions on the export of crude oil, which will provide domestic economic benefits, enhanced energy security, and flexibility in foreign diplomacy.’ Before your Administration took office, the United States emerged as the world’s leading energy producer and a net energy exporter, and American oil production was wisely treated as an arsenal of energy security. House Republicans Demand Answers from EPA on Life Threatening Blackouts and Grid Instability

Washington, D.C. — House Energy and Commerce Committee Republicans are examining the role of U.S. Environmental Protection Agency (EPA) regulations behind increasing risks of dangerous blackouts, which jeopardizes Americans’ safety and security. Americans are suffering enough from record high and unaffordable costs created by President Biden’s energy crisis. They deserve and need every assurance their air conditioning will come on this summer and heat will come on in the winter to keep their families safe. The North American Electric Reliability Corporation (NERC) and other grid authorities say these blackouts are likely this summer and warn of increasing risks in the future. These threats come as the Biden administration continues its rush-to-green agenda to shut down American fossil energy and leave the nation dependent upon intermittent and unreliable sources that strain the electrical grid. In the letter from the members to EPA Administrator Michael Regan, the members demand to know how the EPA’s regulatory actions are affecting America’s both immediate and long-term grid reliability. In particular, they question the Biden administration’s radical “EGU Strategy” in its climate agenda and how that will affect America’s energy reliability. This oversight letter follows letters sent to the Federal Energy Regulatory Commission (FERC) and the Department of Energy (DOE) on June 6, 2022, where the members called on the agencies to “assure reliability in the bulk power system and the affordable, reliable delivery of electricity.” EXCERPT FROM LETTER TO EPA: “We believe the Environmental Protection Agency (EPA) should also account for its plans and actions to help us assess factors behind both the immediate and the long-term risks to electric reliability across the nation. “In recent months, you announced a suite of EPA actions to target fossil fueled electric generating units, an ‘EGU Strategy,’ to drive the Biden Administrations climate agenda. This ‘EGU strategy’ includes many major new regulations now under development or proposed – the Interstate Transport Rule, Regional Haze, Risk and Technology Review for the Mercury Air Toxics Rule, a new set of greenhouse gas performance standards, effluent limitations, and a legacy coal combustion residue rule—all of which directly affect power plants that are essential for reliable electric operations. “We are concerned that EPA actions threaten to accelerate fossil generation retirements, at the very same time electric system operators report growing shortfalls in such baseload capacity will accelerate blackout risks.” The members make several requests of Administrator Regan, including the following: Describe what specific actions you are taking or are prepared to take to address energy or electricity emergencies this summer in the bulk power system. List all waivers or other emergency actions you are considering or have taken over the past two years in connection with electricity reliability. What we Learned in Today’s Oversight Hearing on Baby Formula

Today’s Oversight and Investigations Subcommittee hearing made clear the Biden administration’s failure to quickly act on the baby formula crisis. There should have been a plan before the Abbott plant closed.   Parents across the country deserve answers—and solutions—to the crisis they’re facing.  E&C Republicans questioned the U.S. Food and Drug Administration (FDA) officials and formula suppliers on what more they should be doing to put baby formula back on the shelves and how to prevent this shortage from ever happening again.    Here are our key takeaways from the hearing:   The Biden administration and FDA wasted time and resources.     As Leader Rodgers said, “The Biden administration says it did not anticipate the formula shortage. But it should have. As part of its pandemic response, FDA had a data analytics tool to monitor the supply chains of various products including infant formula.     “The FDA’s food safety center was in contact with the infant formula industry to monitor ingredients and other components for production and to maintain a healthy and safe supply.    “A January Wall Street Journal article, a month before the Abbott plant closed, reported problems of “hard-to-find” formula.      “The FDA didn’t have to quote ‘read minds’ as the President dismissively suggested. They just had to read their own data and listen to parents.”   CLICK HERE to read her full opening remarks.   The FDA failed to plan with urgency for formula supply shortages.   The FDA should have been in rapid response mode immediately to increase the supply of infant formula in the U.S., especially when it knew about problems at Abbott’s Sturgis, Michigan facility that could impact the supply of infant formula. Where was the administration's contingency plan  to prevent the crisis we are seeing today?    Commissioner Califf confirmed to O&I Subcommittee Republican Leader Griffith that the FDA was “too slow .”   According to the timeline the FDA provided in official testimony :     On September 20, 2021, the FDA began a routine surveillance inspection and found problems at the Abbott’s Sturgis facility.    On September 20, 2021, the FDA received a consumer complaint report of Cronobacter illness in an infant.    On September 21, 2021, the FDA informed Abbott of the Cronobacter complaint it received.   On October 21, 2021, FDA received a complaint from a confidential informant electronically. It was reviewed by FDA staff. FDA claims it began planning for an inspection at Abbott’s Sturgis facility.   On October 26, 2021, the FDA Detroit District Office received a hard copy of a complaint from a confidential informant. Due to an “isolated failure in FDA’s mailroom,” this complaint was not shared with FDA leadership.    November 4, 2021, the FDA Office of Human and Animal Food Operations (OHAFO) began discussing the complaint with the FDA’s Office of Criminal Investigations.   November 8, 2021, FDA OHAFO staff discuss confidential informant complaint with the investigator and National Expert Investigator who inspected the Sturgis facility in September 2021.   December 1, 2021, the FDA received a consumer complaint of a Cronobacter death potentially associated with Abbott powdered infant formula.    December 2, 2021, the FDA notifies Abbott of the second Cronobacter consumer complaint.   December 7, 2021, the FDA requested an interview with the confidential informant, which was scheduled for December 22, 2021.   December 30, 2021, FDA contacted Abbott to schedule an inspection for January 3, 2022. Abbott requested FDA delay the inspection due to an ongoing COVID-19 outbreak among its staff. FDA agreed to delay.   January 11, 2022, the FDA received a third Cronobacter illness complaint.     January 27, 2022, the FDA contacted Abbott to announce its intention to proceed with an inspection. Abbott informs FDA of a continued COVID-19 outbreak among its employees.   January 31, 2022, FDA proceeded with an inspection of the Sturgis facility despite the COVID-19 outbreak given the fact pattern indicating a potential issue. FDA found “significant, fundamental sanitation, building, and equipment issues and takes multiple environmental samples.” In short, it took FDA too long to inspect the Abbott facility.   When asked about why complaints and confidential informants weren’t taken seriously and acted upon fast enough, Commissioner Califf admitted :   “There was a failure to escalate, which was a system failure....It was a lack of coordination.”   The failure to share vital information about the looming crisis was a theme among FDA staff testimony. Frank Yiannas, M.P.H, the Deputy Commissioner of Food Policy and Response, is responsible for responding to the whistleblower reports. He didn’t hear about the report for months. He said :   “I’m not sure why the report wasn’t shared with me and how it didn’t get escalated.”    The White House knew about the supply shortages as early as February.   Rep. John Joyce (R-PA) asked Commissioner Califf when the FDA alerted the White House about the closure of the Abbott plant and who was alerted. The response? White House staff were alerted in early February.    Commissioner Califf also said that the FDA gave the White House memos that provided a “very elegant description of the issues and the concerns.”   In a response to Rep. Billy Long (R-MO), Commissioner Califf admitted that FDA has been communicating with HHS Secretary Becerra:   “We’ve been communicating with HHS and having communications with the Secretary …. throughout the pandemic about baby formula.”     The FDA informed the White House of the infant formula crisis in February. Meanwhile, President Biden is claiming that his administration couldn’t predict this crisis. When asked on May 13 th, if the administration could have acted sooner, President Biden said, “If we’d been better mind readers, I guess we could have.”   Again, President Biden said this months after the FDA claimed to have informed the White House.     BABIES NEED FORMULA NOW ACT   As Leader Rodgers said today, parents “need support and immediate meaningful action to increase supply. They also deserve answers.”   That is why she is leading with House Republican Conference Chair Elise Stefanik (R-NY), Congresswoman Ashley Hinson (R-IA), and Congresswoman Stephanie Bice (R-OK) on legislation called the Babies Need Formula Now Act to increase the baby formula supply for parents as soon as possible.    In addition to addressing the immediate crisis parents and babies face, this legislation also requires more oversight and accountability over FDA to ensure the Biden administration is doing its job, acting quickly to maintain a healthy and safe supply of formula, and not wasting resources. To ensure parents have more choices in the future, it also reduces barriers to innovation for new brands and types of formula to enter the marketplace.   The details:   Increasing Supply: The Babies Need More Formula Now Act makes sure the FDA is using every flexibility to import safe baby formula from abroad. It also temporarily lifts restrictions on infant formula to allow parents to order formula from countries that have similar safety standards as the United States.   Requiring the FDA to be Transparent: Just giving the Biden administration more money will not address the immediate crisis or correct how it made these shortages worse. The Babies Need More Formula Now Act adds oversight and accountability to the FDA to make sure it is doing its job and acting quickly to maintain a healthy and safe supply of formula.   Giving Parents More Choices: To prevent dangerous shortages from happening again, this solution also lifts FDA-imposed barriers that restrict new types and brands of formula from entering the market. It ensures more competition so more formula will reach the shelves and parents have more options to keep their babies fed.   Enhancing Accountability for Recalls: When there is a recall for labeling unrelated to the quality of the product, the FDA needs to consider the impact to the supply of formula before recommending or requiring a recall. The Babies Need More Formula Now Act requires the FDA to notify to Congress of recalls and provide a plan to address any supply issues that may result. It requires coordination between the FDA and the manufacturer of the recalled formula to resolve any issues as soon as possible.   MEMBER MOMENTS
